About the Ailee Jong Case against John Muir Health (John Muir Hospital Walnut Creek)

We filed suit against John Muir Hospital and five doctors alleging that the marketing of John Muir Hospital as “Stanford” deceived parents into believing that the quality of care at the two facilities was equal. We claim that the Stanford name was more branding than reality. John Muir disagrees and asserts that the child was fragile and given the best care possible. The lawsuit will determine right and wrong. The Chronicle article below details how John Muir was warned not to perform a liver resection on this young child as the whistleblower believed that John Muir Hospital lacked the experienced team necessary to be successful. John Muir claims it considered these claims and made a reasoned decision to proceed.

The Medical Board of California is now investigating this matter.

The core complaint is that the John Muir Hospital leadership failed the public by promoting a “John Muir Hospital – Stanford” partnership which did not provide Stanford level care to John Muir Hospital pediatric patients. This branding equated John Muir with Stanford in a way that (we contend) misled the public. John Muir Hospital’s publicity team (or legal team) have given their counter arguments to the San Francisco Chronicle and you should read both sides. Our lawsuit was challenged by John Muir Health but the count alleging Fraud (as pled) was found to be outside the scope of medical malpractice limitations and we are proceeding on that count.
