What Laws Govern How the Medical Board of California Operates

The Medical Board of California has published the list below. It is the list of pure statutes that by intention and design affect boards and the California Medical Board. It is useful to review these and this resource will assist both attorneys and physicians. But when we handle a MBC case, we look at other statutes that are not listed. The U.S. Constitution, California Constitution, rights to privacy, due process and other matters which are not listed below must be read into these statutes in order to best protect your rights. Doctrines such as “Underground Regulations”, procedural due process, challenges to statutes such as Penal Code section 23 on due process grounds and many other legal doctrines must be utilized when a physician’s license is at risk. The Horowitz Medical Law Group has many years of experience raising out of the ordinary and critical legal issues on behalf of our clients. We have changed laws in state and federal courts raising issues that were new and persuasive in the California and federal courts. When our medical law group represents you, we will view the laws as generally applicable just as any medical attorney must. But emblematic of the work of our medical defense group, we also assert your core rights under both statute, constitutional law and by pushing the boundaries of accepted law to a fair and proper balance point.
